1. About this document
This document explains the terms of the 24 Moons newsletter and how 24 Moons PTY LTD ("24 Moons", "we", "us" or "our") handles personal information connected with subscriptions, newsletter delivery and email engagement.
It applies to subscriptions made through our website, links page or another authorised signup process, whether we send a newsletter through our own email infrastructure or an approved provider such as Mailchimp.
This is the primary notice for newsletter-specific matters. Our Website Privacy Policy and Cookie Notice explain website browsing, forms, analytics and advertising. Our Staff Portal, Admin Portal and Webmail Privacy Policy and Terms of Service address internal account use.
These documents work together. A general summary elsewhere does not expand your newsletter consent or reduce the protections described here. This privacy notice explains our handling of information; acknowledging it is not blanket consent to every possible use of your data.
2. Subscribing
Our public signup form asks for your first name, email address and an affirmative choice to receive marketing emails from 24 Moons. Subscribe using an address you control. Do not subscribe another person without their authority.
We may ask you to confirm your subscription by email. Where confirmation is required, follow the instructions provided. Confirmation requirements can depend on the signup method and delivery provider.
Providing information for an enquiry, booking or employment matter does not itself subscribe you. Accepting website cookies does not subscribe you, and joining the newsletter does not enable optional website analytics or advertising cookies.
If an authorised staff member adds an address through another process, we must have a valid basis to send marketing and retain appropriate evidence of consent. An imported contact list does not itself establish permission to send newsletters. We will not use harvested addresses.
You can withdraw your marketing consent at any time. These terms do not require you to remain subscribed.
3. The newsletter service
The newsletter is free to subscribe to. It may include event announcements, recorded sets, venue news, ticket links and related 24 Moons promotions. Frequency varies according to our programme and communications; we do not promise a fixed schedule.
Subscription does not purchase a ticket, reserve a place, guarantee availability or confer venue membership or admission. Any ticket purchase, booking, competition or offer is subject to its separately stated terms. Check current event information before making plans.
We take reasonable care with newsletter content but dates, lineups, prices and availability may change. We do not guarantee that every email will be delivered or reach your inbox. These statements do not exclude rights or remedies that cannot lawfully be excluded.
Do not misuse signup, preference or unsubscribe functions, interfere with delivery, impersonate another subscriber or use newsletter content in a way that infringes another person's rights.
4. Unsubscribing and changing your details
Every marketing email must identify 24 Moons and include a clear unsubscribe option. You can also email info@24moons.com.au from the subscribed address and ask to stop receiving marketing.
We will action unsubscribe requests as soon as practicable and within five working days. We do not charge an unsubscribe fee or require you to create an account, sign in or provide extra personal information. Unsubscribe facilities must remain functional for at least 30 days after the message is sent. These commitments reflect ACMA's spam guidance.
An unsubscribe request stops 24 Moons newsletter marketing to that address across the delivery systems we use. It does not prevent a necessary non-marketing response to an enquiry or a transaction you initiated, and those messages must not be used to bypass your choice.
Contact us if a link fails, marketing continues after the processing period or your details need correction. We may retain the minimum suppression information needed to prevent accidental resubscription. We will not treat an old subscription or a routine list import as fresh consent after you have unsubscribed.
5. Information we collect
Depending on the signup and delivery method, newsletter-related information includes:
- your first name, email address and subscription preferences;
- subscription status, relevant list membership, signup source and available records of when and how permission was given;
- confirmation, unsubscribe, suppression and preference-change records;
- the campaigns or automated emails sent to your address and associated delivery status;
- bounced-message information, delivery errors and spam complaints;
- email opens, link clicks, the relevant campaign and link destination, and the dates and times of those events;
- subscriber and message identifiers needed to deliver emails, manage unsubscribe links and associate engagement with a subscriber;
- correspondence about your subscription, requests or complaints.
Our own newsletter engagement records contain subscriber and campaign identifiers, event type, time and, for tracked clicks, the destination link. They do not store an IP address or raw browser user-agent in those engagement records. Hosting logs and external delivery providers may separately process IP addresses, device or browser information, approximate location and other technical information.
We collect information directly from you, through email interactions, from authorised staff recording a subscription, and from the providers we use. We do not require your payment details, identity documents or sensitive personal information to join the mailing list.
6. How we use information
We use newsletter information to:
- maintain subscriptions and relevant permission records;
- deliver requested emails and personalise them, for example with your first name;
- administer lists, prevent duplicate sending and respect unsubscribes;
- investigate delivery problems, bounces, complaints and misuse;
- measure engagement and improve newsletter content and timing;
- where used, group subscribers or select automated follow-ups based on factors such as list membership, signup date, previous sends, opens or clicks;
- answer requests, protect the service and meet applicable legal obligations.
For example, a follow-up may be directed to subscribers who clicked a previous newsletter, or excluded from people who recently received another message. Engagement signals are imperfect and are not proof of a person's interests or attendance.
Newsletter consent does not authorise unrelated marketing or the collection or inference of sensitive information without any separate permission or legal basis required by law. We do not sell or rent our newsletter contact list. This document does not authorise uploading subscriber addresses to advertising audiences; any such use would require its own assessment, disclosure and permission where required.
7. Email open and link tracking
Newsletters may contain a small tracking image and tracked links. When an image loads or a tracked link is followed, the system can associate that event with your subscriber record and the relevant email. This is not anonymous tracking.
We use this information for reporting and the newsletter selection and follow-up purposes described above. Where applicable law requires specific consent to tracking, we must obtain it before enabling the relevant tracking. Consent to receive marketing must not be treated as unlimited consent to other processing.
Email applications, privacy proxies and security scanners may load images or open links automatically. Forwarded emails may also generate activity against the original subscriber. Open and click reports therefore may not reflect what you personally read or selected. Mailchimp explains these limitations.
Blocking remote images in your email application may reduce open tracking, but it does not necessarily prevent tracked-link measurement. Website cookie settings do not control tracking inside an email or a tracked email redirect.
Contact us if you want to discuss tracking or your information. We do not currently promise a separate tracking-free subscription option. You may unsubscribe at any time. Treat personalised unsubscribe and preference links as private; someone receiving a forwarded copy may be able to use them.
8. Website analytics, cookies and advertising
If you follow a newsletter link, the destination website's notices and controls apply. Clicking a newsletter link does not itself grant optional website consent.
Our website uses its own anonymous interaction counts, consent-based session analytics, Google Analytics and Meta Pixel, as explained in the Website Privacy Policy and Cookie Notice. Google Consent Mode may also send cookieless measurements where analytics storage is declined, as disclosed in those documents.
A recognised campaign label can tell our website which newsletter brought a visit. With Analytics permission, our own website reporting uses that campaign label for grouped traffic reports; it does not include the subscriber's name or email address in those website measurement records. The preceding email-link click can still be recorded against the subscriber under section 7.
An email tracking image is separate from Meta Pixel on our website. Declining website Marketing does not unsubscribe you or disable newsletter open and click records.
9. Service providers and disclosures
Authorised staff can access newsletter information where needed for communications, support and administration.
We use our own application and approved hosting and email services to maintain subscriptions and send emails. Depending on the selected delivery channel, this can include Mailchimp or mailing-list software on our hosting platform. Relevant records may be synchronised between systems to administer the service and respect subscription status.
Providers may process information needed for delivery, reporting, security and support. Mailchimp's relevant notices include the Intuit Global Privacy Statement and Mailchimp Cookie Statement. Our responsibilities for information we control continue when we use a provider.
We may disclose information to professional advisers or authorities where reasonably necessary and legally permitted or required. A link to an artist, promoter, ticket seller or partner does not itself mean we provide that organisation with our subscriber list. Its own practices apply when you visit its site.
10. Overseas handling
When Mailchimp is used, information is processed in the United States, where Mailchimp states its servers are located. Other provider or support operations may involve additional countries. See Mailchimp's server-location information.
We take reasonable steps required by applicable law to protect information handled overseas. This document does not ask you to waive applicable overseas-disclosure protections.
11. Security and retention
We take reasonable steps to protect newsletter information from misuse, loss and unauthorised access, alteration or disclosure. Controls include restricted administrative access and encryption of subscriber names, email addresses and unsubscribe secrets in the local mailing-list database. No system can guarantee complete security.
We retain active subscription details while needed to deliver the requested service. Consent, suppression, delivery and engagement records are kept only as long as reasonably necessary for their purpose and applicable legal requirements. We review information for deletion or de-identification when no longer needed, subject to legal holds and backup processes.
Unsubscribing stops marketing; it does not automatically erase every record. Limited suppression information may be needed to honour your request. Newsletter records are not covered by the website analytics system's 90-day retention period.
We will assess suspected data breaches, take appropriate remedial action and notify affected people and regulators where required by law.
12. Access, correction and complaints
For access, correction or deletion requests, or a privacy complaint, contact info@24moons.com.au, addressed to the Privacy Officer. Explain the issue and the outcome you seek. We may need to verify your identity for information-access requests; this is separate from the simple unsubscribe process.
We will consider requests under applicable law, explain any lawful refusal and tell you about available complaint options. A deletion request may be subject to necessary suppression, legal and record-keeping requirements.
We aim to respond to privacy complaints within 30 days. If more time is needed, we will explain why and provide an expected response date, without extending any shorter legal deadline.
If you are dissatisfied, you can approach the Office of the Australian Information Commissioner where it has jurisdiction. Concerns about unsolicited marketing can be raised with the Australian Communications and Media Authority.
13. Changes to the service and this document
We may change, pause or discontinue the newsletter, or suppress an address where reasonably necessary because of bounces, complaints, security concerns or misuse.
We may update this document when our practices, providers or legal obligations change. We will publish the current version and notify subscribers of material changes where appropriate. A change does not retrospectively expand consent or authorise a new purpose requiring separate permission. You can unsubscribe at any time.
14. Applicable law and your rights
These terms are governed by the laws of Victoria and applicable Commonwealth laws. Subject to mandatory jurisdiction rules, the parties submit to the non-exclusive jurisdiction of Victorian courts.
Nothing in this document excludes any statutory guarantee, privacy protection, complaint right or remedy that cannot lawfully be excluded. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible.
